Petition for a due examination of Martin Šimůnek´s case
We, signed herein, the Czech Republic Citizens and other countries Citizens, strongly protest the sentencing of the Czech coach of the Acrobatic gymnastic team Mr.Martin Šimůnek to seven years imprisonment for sexually abusing and endangering the morals of a girl.
In a democratic country someone should receive a chance to prove his/her innocence. If someone is sentenced then his/her guilt must be proven clearly. We do not agree with practices of the court as it has not shown any clear evidence against Mr. Martin Šimůnek and moreover has taken from him the possibility to vindicate himself.
We strongly state that the court´s decision just from the opinion of only one professional expert who wrote the report unlawfully after working in the same clinic where the mentally unstable girl had been hospitalized. Furthermore this report indicates clearly that she suffered from depressive sequence with psychotic conditions, she heard voices and had visual hallucinations earlier. Moreover she was beaten and kicked during her childhood by her mother. Despite these facts her testimony is considered trustworthy while other fully-healthy witnesses´ testimonies are considered untrustworthy. We warn that all witnesses who gave testimony for the benefit of Mr.Martin Šimůnek were considered untrustworthy. We warn that the court blocked elaboration of an independent psychological report of the girl and also examination of the doctor who made a complaint.
We point out that Mr.Martin Šimůnek is a respectable man who has never been accused of a crime. He has brought up lots of gymnasts during his long sports career who all support the evidence of his innocence.
On the bases of these and many other facts that we are able to address the court we call for a new examination of the case that includes independent professional expert and a new trial in front of an independent court. Our claim is supported by Helsinki Human Rights Committee, too. We also ask to be kept informed about all steps that will be done by competent authorities in this case.
